South Africa's Children's Act 38 of 2005

Parliament of the Republic of South Africa

The Children’s Act 38 of 2005 gives effect to constitutional rights of children and establishes a legal framework for their care and protection. It addresses parental responsibilities and rights, children’s courts, adoption, inter-country adoption, child abduction, alternative care, surrogate motherhood and offences involving children. The Act also establishes principles concerning the best interests and participation of children and provides for cooperation among institutions involved in child protection. It has been amended by several laws, including the Children’s Amendment Acts of 2007, 2016 and 2022 and other related legislation.
