Child Justice Act 75 of 2008

Parliament of the Republic of South Africa

The Child Justice Act 75 of 2008 establishes a separate criminal justice framework for children who are accused of committing offences. It sets rules concerning criminal capacity, assessment, preliminary inquiries, diversion, child justice courts, sentencing, legal representation and restorative justice. The Act is designed to protect children's constitutional rights while also promoting accountability, rehabilitation and reintegration. It has been amended by later legislation including the Child Justice Amendment Act 28 of 2019 and the Cybercrimes Act 19 of 2020.
